All arriving citizens, residents, and visitors to the U.S., must be admitted and inspected upon reentry to the U.S. after traveling abroad. A Lawful Permanent Resident or green card holder with certain criminal convictions may be detained at a Port of Entry upon return to the United States if a determination regarding admissibility cannot be made.
Depending on the nature of the conviction, the individual may be mandatorily detained or given a later date for deferred inspection. If given notice of a “Deferred Inspection” appointment, s/he should return to the airport with certified criminal records of any and all incidents the individual has been convicted of. If the officer is not satisfied with the evidence presented, s/he will refer the case to the Immigration Court having jurisdiction over the matter to make a final determination.
